Archdiocese of St. Louis ordered to produce 20 years of documents on sexual abuse

A judge has ordered the Archdiocese of St. Louis to produce two decades worth of internal documents on sexual abuse allegations.

Thomas J. Prebil is only the second judge to attempt to compel the archdiocese to hand over such an extensive number of records.

The order, released earlier this week, is part of a civil lawsuit filed in St. Louis County Circuit Court involving the parents of a man from Florissant who sued the archdiocese over the suicide of their son.

The parents argue their son’s suicide in 2009 was the result of sexual and emotional abuse by Bryan Kuchar, a Roman Catholic priest at Kenrick-Glennon Seminary in Shrewsbury.

The documents are needed in order to show that the archdiocese had a pattern of reassigning problem priests, plaintiff lawyers argue.

 

The records are also essential in proving that the archdiocese made such reassignments knowing they would almost certainly lead to further harm — the burden of proof plaintiff lawyers in Missouri need to meet in sexual abuse lawsuits involving priests such as Kuchar.

Plaintiff lawyers made clear, however, that because of a protective order, the records, which will cover 20 years of allegations prior to the alleged abuse at the heart of the Kuchar case, will not be made available to the public but only used in trial.

Kuchar was suspended by the archdiocese in 2002 and defrocked by the Vatican in 2006. He is accused of molesting the plaintiffs’ son at the seminary’s overnight camp between 1999 and 2002.

The boy — known in court documents as John Doe SON — was between 12 and 14 at the time. Minors who wanted to learn more about how to become priests attended the camp.

Kuchar was found guilty of molesting a 14-year-old boy in 2003, while serving as a priest at Assumption Catholic Church in south St. Louis County. He was sentenced to three consecutive one-year terms in the St. Louis County Jail.

The last time the archdiocese was forced to produce such an abundant number of records was in 2013 in a case involving Joseph Ross, who in 2002 became the first priest in the archdiocese to be defrocked by the Vatican.

Throughout the discovery process, plaintiff attorneys and the archdiocese battled over how much information the church should disclose about prior allegations of sexual abuse.

Ultimately, it took a Missouri Supreme Court ruling for the archdiocese to hand over the names of all priests accused of abuse.

Although the case involving Ross ultimately settled, the public was for the first time made aware that 115 priests and other church employees dating back decades had sexual abuse allegations lodged against them.

MILWAUKEE (WITI) — A federal appeals court has issued a ruling that puts nearly $60 million back in play. It’s cash that could be paid to victims in the Catholic clergy sex abuse scandal. It is a blow to the Archdiocese of Milwaukee’s bankruptcy case and it could have wide-ranging effects.

With the clergy sex abuse scandal creeping closer to church coffers, then-Milwaukee Archbishop Timothy Dolan set aside millions in a cemetery trust fund. He then fought to protect that money from abuse lawsuits in bankruptcy court.

“What this did is delay, by years, the place we already should have been at the beginning,” Peter Isley, Midwest Director of SNAP – the Survivors Network for Those Abused by Priests said.

FOX6’s Mike Lowe: “You know, the accusation is that he was trying to shield assets from lawsuits.”

“No. And I…as I’m sure…I’m sure you read Cardinal Dolan’s respnse to that.  There’s no truth to that,” Listecki said.

FOX6’s Mike Lowe: “Well, he in the report says, quote, ‘I foresee an improved protection of these funds from any legal claim and liability.’ How do you explain that?”

“When I say due diligence, he was doing due diligence, making sure the trust always would be maintained as a trust,” Listecki said.

“There is so much smoke blasting out of that gun, okay, it’s in writing,” Isley said.

Isley, himself a victim of clergy sexual assault is now the Midwest Director of the Survivors Network of Those Abused by Priests. He says the cemetery trust fund amounts to federal bankruptcy fraud.

“What counts is that they took money from one place,  millions of dollars, hid it away legally and then came to federal court and said ‘ we don’t have the money,’” Isley said.

In a statement on the ruling, the Archdiocese of Milwaukee’s lawyer said: “This decision casts a shadow over religious freedom.”

“There’s a long, long history of people justifying what they’re doing,” Isley said.

Isley says he believes the latest ruling now means Cardinal Dolan will be the cardinal who approved it and even possibly that former Pope Benedict XVI could be deposed in this case.

Bob Jones University President Steve Pettit said Tuesday that the weeks since school leaders were criticized for the way they counseled victims of sexual abuse have not been easy on anyone.

“It has been particularly difficult on a few,” he told students during a chapel service in which he spent 16 minutes responding to a yearlong investigation by Godly Response to Abuse in the Christian Environment.

He did not name those he was talking about, but the two most harshly criticized by the GRACE report were Bob Jones III, the chancellor and grandson of the founder, and Jim Berg, who handled most of the counseling during almost 30 years as dean of students.

GRACE found that students who reported abuse were blamed for bringing it on themselves and that proper authorities had not been notified. The organization said Jones, as the president from 1971 until 2005, and Berg, who stepped down as dean in 2010, were primarily responsible.

The report recommended that Jones be disciplined and that Berg be banned from both counseling and teaching counseling and that the school no longer use or sell his books or DVDs.

Pettit gave a general response during chapel service and referred to the university’s website for more specifics.

The website said personnel matters are private and will not be made public. It also said Berg’s sermons and materials were reviewed and found to be biblically sound. The school will continue to sell them and to use them in courses.

“Thousands of believers have benefited from his books and hundreds of churches have used his materials with great spiritual profit,” the website said.

Jeffrey Hoffman, who talked with GRACE investigators about being molested when he was 9 by a BJU staffer who worked at his church, said he was disappointed with the school’s response. Hoffman was born on the campus and went to school there through high school.

“It doesn’t sound like it’s going to change a thing,” he said. “What they’re saying is the Bible is sufficient but they hired some people who told them what they were doing isn’t biblically sound and it’s not psychologically sound and this is them saying we’re going to stick with our amateur guy.”

The GRACE report identified Jones III and Berg as two of the biggest problems, Hoffman said.

“GRACE was giving them the ability to jettison all the old and move forward with all of the new,” he said. “Outside therapists who are committed Christians, a road map to the future and they slammed the door shut.”

Berg told GRACE investigators he had on-the-job training in addition to reading books and articles and attending a conference. His style of counseling was criticized by several victims who said he asked rapid-fire and personal questions such as whether they had been drinking or had been involved with the man before.

Hoffman also said he felt dismayed that the university was not going to announce whether any personnel changes were made.

“They don’t feel like they are accountable to anyone,” he said.

Focused on rules

Berg was recently featured in a video about the seminary, and the website lists the itinerary for trips Jones III will make to North Carolina and Wisconsin later this month and to Singapore in May.

In 2012, Stephen Jones, then president of the university, asked GRACE to conduct the review, which began in January 2013 with an online survey. The investigative team included a lead investigator who is a lawyer and former prosecutor, a mental health professional, a seminary professor, a project coordinator and a project director.

They talked not only with victims but also those who knew victims and people who had heard sermons or attended classes that dealt with the issue. They gathered police reports, court documents, class materials, counseling records, recordings of sermons and lectures and training videos made by Berg and others.

About half of 43 victims interviewed were abused before arriving at BJU, the other half while they were students there, the report said. Sixty percent of them said they felt blame and disparagement for coming forward. One third of the victims said they did not feel comfortable telling school administrators of the abuse.

Pettit said since the report came out he has communicated with one of the women who was interviewed by the GRACE team and came away feeling grieved that she had not been helped.

“We did not understand the depths of her trauma,” he said.

Also in his remarks to students, Pettit called sexual abuse a heinous crime that requires abusers be brought to justice. He noted that some had been helped by loving counseling but acknowledged that others had not. As he did when the GRACE report was released, Pettit asked for forgiveness from victims.

He said it was apparent that the university was too focused on rules and not enough on people.

“Over the years our system of discipline created barriers with many of our students. Some students reported that they were afraid to share their problems out of fear of facing discipline,” he said.

The GRACE report identified several students who had been expelled or asked to leave the university after telling a school official about abuse that had taken place before they were students there.

One student who left the university before earning a degree will be allowed to return, the university said on its website.

Previously, the university’s discipline and counseling were handled by one man, Berg.

“We did not discipline in love,” Pettit said.

Pettit said many of the changes in the university’s procedures were made before the GRACE report came out.

A full-time women’s counselor was hired in 2012. In 2013, the university’s policies on sexual abuse were rewritten and updated again in 2014 based on recommendations of a Fort Worth, Texas, organization called MinistrySafe. Also in 2014, the university separated women’s counseling from the office that handles discipline. That ensures confidentiality, the university said.

Several students told GRACE their privacy had been breached by school personnel, including one woman who said her hometown pastor was called.

Reporting abuse

All employees are considered mandatory reporters — those specifically required by state law to report all allegations they become aware of — which the university said exceeds state and federal law.

The GRACE report faulted the university for not reporting certain allegations, but Pettit said the panel he put in place to review the report found no instances where any law had been broken. In addition, a former prosecutor in the U.S. Attorney’s Office reviewed all the university’s files on people who had reported sexual assault or abuse and found the university had followed the law.

Pettit said he knew some BJU supporters want to put the GRACE report behind them.

“I want to keep it before us,” he said. “I don’t want to forget what happened.”

He said he has asked for a comprehensive review of student life, which would include student leaders. Besides discipline and counseling, the review will include the code of conduct, living in a dorm and leadership training.

“The culture of our student experience has been a point of struggle for some of our students,” he said. “The primary point of struggle was not so much the rules but the way they were handled or enforced.”

He said he believes most students agree with the rules, but want to be treated like adults.

“We are not going to change our belief that the Bible is our authority and guide for spiritual life and growth, but we are going to become more biblically focused on our student experience at BJU.”

The GRACE report described an atmosphere of fear that extended into dorms, where students were encouraged to tattle on each other. At the center of this is a rule in place ever since the school was founded in 1927 in Panama City, Florida, by evangelist Bob Jones Sr. He required that if someone knows a rule is being broken and doesn’t report it, he or she is as guilty as the rule breaker.

The university also will begin a more formal victim advocate program and develop more training for faculty as well as members of the Board of Trustees.

In addition, the university is planning a student care center. The details of the center were vague, but the website said students can expect help with “a variety of issues and it will include an appropriate number of biblical counseling personnel.”

When the GRACE report was made public in December, Pettit announced a committee would study it and report to him within 90 days. That group included a biblical counselor, an executive administrator of a regionally accredited university, a professor of pastoral counseling, an attorney who works in abuse and abuse prevention, a human resources executive and a member of the BJU Board of Trustees.

The committee members asked the university to not release their names. The committee met with university officials in February, the website said.

Pettit attempted to draw a line between BJU now and BJU before.

He announced at the chapel service that 392 students signed what was called a statement of empathy for victims. He called it “a clear example of the BJU of today.”

He said that some might think paying for such a report was misguided.

“I believe we were providentially guided by God’s hand,” he said.

Others think the university leadership should have come out swinging, defending itself and its past.

“We wanted our former students to know they were more important that our institutional reputation,” he said.

Harrison, who allegedly shot a young drug dealer execution-style — an English High student he was supposed to be “mentoring.”

Truth is, Mark Scott, of the Ella J. Baker House in Dorchester, has been working for more than a year on his idea to have ministers create a partnership with police, social workers, probation officers and street workers.

It’s a back-to-the-future idea — back to the days of the so-called Boston Miracle and operations dubbed “Nightlight” and “Homefront,” when teams of ministers, cops, probation officers and school police quite literally made sure that the kids they were tracking were at home, if not in bed.

The father of probation in Dorchester District Court, William J. “Billy” Stewart, one of the architects of the Boston Miracle, was once asked what happened to the Miracle and the TenPoint-Coalition of black clergy.

“It’s quite simple actually,” Billy replied. “One TenPoint Coalition turned into 10 one points.”

In other words, success bred egos determined to do their own thing. And two decades later we have an anti-gang preacher in the arraignment dock accused of attempted murder and facing a slew of drug and weapons charges.

As Billy Stewart so succinctly put it, “A guy who was supposed to be mentoring kids wound up exploiting them.”

Scott wondered yesterday if the rogue rev was actually working for his cadre of young thugs instead of the other way around.

“I haven’t seen or spoken to Shaun Harrison for over a year,” he said. “Few if any of us in the Black Ministerial Alliance have. But I was one who knew him and knew that at one point he did do some inspired work with kids on the edge.

“But Shaun always chafed at being part of a larger structure. He always wanted to do it his way.”

And so he did.

What Scott envisions is a corps of ministers whose credentials will be scrutinized and assigned to a team of Boston police, school cops and social and street workers.

“We need to make sure we are collaborating,” Scott said, “that we are transparent, that we provide opportunity for people who want to work with troubled youth, but do it in a way that’s safe for them, safe for the people they’re reaching out to and do it in a way that doesn’t burn them out.”

The desire to help save kids is noble, but it’s not enough. Mark Scott, who’s worked at it for most of his adult life, says what potential saviors need is structure and accountability.

The alternative is Rev. Shaun Harrison.

Four weeks after giving evidence before a royal commission, victims of child sexual abuse within the Orthodox Jewish Yeshivah centres in Melbourne say they are frustrated by a lack of action by senior centre staff.

In an open letter directed to Yeshivah management in Melbourne and published on Wednesday, 11 abuse victims said they were dismayed by a lack of resignations following the hearings, during which it was revealed senior staff knew about the abuse, but did nothing.

Last month, the royal commission into institutional responses into child sexual abuse held public hearings at Melbourne’s county court to examine the way the Yeshivah centres, which run schools, religious activities and youth groups in Sydney and Melbourne, responded to child sex abuse in their community.

“It is astounding and a further indictment on the Yeshivah Centre that no genuine public action has been taken to date by your institution in response to the royal commission public hearing,” the letter said.

“As those who have suffered most at your institution’s hands, we would like to once again register our shock and pain at the Yeshivah Centre’s continued mishandling of this ongoing scandal.

“We strongly believe that the removal of yourselves, as well as key staff and volunteers from the Yeshivah Centre who have been implicated in any way in this ongoing scandal, is now required.”

Among the signatories was Manny Waks, who told the commission about the abusive emails and messages he received from senior members of the Orthodox Jewish community since going public about his abuse in 2011.

He was unsupported by senior Yeshivah staff, he said, and ostracised by the community, ultimately deciding to leave the country.

Waks told Guardian Australia on Wednesday that it was “frustrating, disappointing and hurtful” to see the way Yeshivah has continued to mishandle this issue.

“I genuinely believed they had learned something from the past few years as highlighted at the public hearing,” he said.

“It seems to me that very little if anything has changed.

“I hoped and expected that moving forward my role would be to only heap praise on Yeshivah for their shift in approach. Sadly I was wrong. The fact that so many past Yeshivah victims felt compelled to issue such a letter should highlight the incredible pain and suffering they continue to inflict upon so many of us.”

Since the hearings, Waks said he had been contacted by several more victims from within the Jewish community.

A Yeshivah Melbourne spokesman said the centre would not be responding to the letter. “We will have an announcement about substantive initiatives in the coming days,” he said.

A spokesman for Yeshivah Sydney, Rabbi Eli Feldman, said a voluntary workshop on recognising and responding to child sexual abuse had been offered to members of the Rabbinical Council of NSW.

About 30 rabbis and their wives had attended the workshop, he said, including Rabbi Yosef Feldman, who resigned from his position as director of the Melbourne Yeshivah Centre after being widely criticised for evidence he gave to the royal commission.

Baldwin County District Attorney Hallie Dixon says subpoena she ignored was invalid

Attorneys representing a former St. Pius X Catholic School student accusing administrators of allowing her to be bullied are seeking a court order sanctioning Dixon for failing to appear at a deposition on Friday. They wanted to ask her questions about allegations her office reviewed involving the pastor of St. Pius. The pastor, the Rev. Johnny Savoie, oversees the school principal.

Dixon said on Tuesday that the subpoena was invalid because rules governing civil cases require plaintiffs to file a notice of their intent to question a non-party and then give other lawyers in the case 15 days to object.

“The lawyers who filed that motion and gave those comments need to read the Rules of Civil Procedure and educate themselves about what the Rules of Civil Procedure are,” she said. ‘Their motion not only does not have any merit, it’s exactly against what the Rules of Civil Procedure are.”

Kennedy said Tuesday that Dixon’s interpretation of the rules is incorrect, adding that he would provide a detailed explanation in his next court filing on the matter.

Dixon asked Mobile County Circuit Judge Sarah Stewart last week to block the subpoena on grounds that state law protects the disclosure of investigative records and material of law enforcement authorities.

Dixon previously has said that the Archdiocese of Mobile alerted her office in December 2013 about an allegation it received that Savoie had an improper relationship with a 16-year-old boy nine years earlier. She said that since the age of consent in Alabama is 16, she determined that no crime had been committed.

Savoie disclosed the allegation to his congregation in February of last year, telling parishioners that the allegation was false and that a lie detector test he took confirmed his version of events, according to court records.

Lawyers for the school have argued that the allegation is irrelevant to whether Savoie and other officials responded appropriately to reports of bullying against students. The lawsuit is one of four making those allegations.

Stewart has indicated that she will take up the contempt motions and other matters on March 20.

Dixon said the motion she filed seeking to “quash” the subpoena is standard.

“There are a lot of lawsuits … that try to drag the state of Alabama into them,” she said.

The law prevents that unless a judge overrules the objections, Dixon said.

“Any decent lawyer would at least check to make sure their position is correct,” she said.

As to the lawsuit, itself, Dixon said: “We have no position. We’re not on one side or the other. I don’t, and my office doesn’t, have a dog in this fight.”

Attackers delivered beatings, death threats to force a divorce, victim testifies in Lakewood rabbi trial

A Brooklyn man testifying Tuesday in the trial of a Lakewood rabbi accused of orchestrating forced divorces said he was ambushed and beaten until he agreed to divorce his wife.

The daylong testimony of Yisrael Meir Bryskman in federal court in Trenton did not connect Rabbi Mendel Epstein or his three codefendants to the 2010 attack but it set the stage for prosecutors’ main witness who could provide more potentially damning evidence in the trial.

Bryskman, a 40-year-old Israeli national who fled his state to avoid warrants for his arrest for refusing to grant a divorce, described for jurors how he was beaten over several hours at the Lakewood home of David Wax, a man he thought was going to give him a job.

Wax, who is scheduled to testify on Wednesday, is the prosecution’ main witness linking Epstein, his son and two other rabbis to the beatings.

But defense attorneys contend that Wax, who faces life in prison for Bryskman’s kidnapping, concocted the allegations against Epstein, his son David “Ari” Epstein and rabbis Binyamin Stimler and Jay Goldstein to receive a reduced sentence.

Epstein, a prominent rabbi who specializes in divorce proceedings, is on trial along with his son and rabbis Stimler and Goldstein, on conspiracy and kidnapping charges that grew out of a federal undercover sting. They allege the elder Epstein ordered the beatings while others carried them out. Bryskman is the second beating victim to testify in the trial, now in its fourth week.

Bryskman, a tall thin man with light brown hair under his black yarmulke, is the secondvictim to testify. He sat calmly as he testified before U.S. District Judge Wolfson about the events that started late Oct. 16, 2010, and went into the early morning hours of the following day.

He told of how he searched out Wax, who ran a religious publishing operation from his home, for a job. He said he met with Wax for more than 10 hours on two separate occasions before Wax suggested the third meeting where they were supposed to discuss details about employment.

Bryskman said that he was attacked from behind as he walked into Wax’s bedroom, which also served as his office.

A single punch to the face knocked him to the floor before an unknown number of men, including Wax, blindfolded him, handcuffed his hands behind his back and bound his ankles.

While he lay face down on the floor, they beat and kicked him, he said.

“The first punch landed on my face,” Wax told assistant U.S. attorney Sarah Wolfe. “It felt like some kind of boxing glove.”

Soon after the beating started, the men ordered him to repeat the Hebrew words they were barking, he said. Those “special words,” he said, were saying that he agreed to give his wife a religious divorce, known as a get in the Orthodox Jewish religion.

The beatings did not end with that declaration, he said.

At one point, someone tried to pour a liquid into his mouth then doused his head with it, Bryskman told the jury of eight men and eight women.

Another time, Wax, wearing a white cowboy hat, pulled his head up by his hair and asked him “how do you like my cowboy hat?” Bryskman said.

He said some type of chemical was sprayed in his face, causing a burning sensation.

Eventually, Wax brought Bryskman, to the front steps of the house, uncuffed him and got into a cab with him. The cab took the two men to an automated teller machine where Wax ordered a bruised and bloodied Bryskman to withdraw money to reimburse him for the carpet he stained with his blood, Bryskman said. Bryskman said he was so scared he couldn’t remember his personal identification number to access his account.

After that ride, the cab took them to a local Wawa convenience store where they met up with Wax’s wife, Judy, who was in her sport utility vehicle, Bryskman said.

They agreed to take Bryskman to his cousin’s home in Brooklyn, but on the ride, Wax tried to extort money from Bryskman’s father in Israel by calling him and threatening to kill Bryskman, he said.

He said that before dropping him off at his cousin’s house, Wax ordered him not to call police. Bryskman said he initially complied, but then decided to report the incident the following day.

“I did not want to report it to the police because I was threatened,” he said. “I was afraid.”

Defense attorneys contend their clients had nothing to do with the beatings and that Wax devised the allegations against them to get a more favorable sentence.

In their cross-examinations of Bryskman, defense attorneys Robert Stahl, who represents Rabbi Epstein, and Henry Mazurek, who represents the younger Epstein, grilled Bryskman about leaving Israel in 2007 to avoid being arrested for refusing to grant his wife a get.

Bryskman said he initially went to Canada but then moved to Brooklyn to be with family. He said he bounced around living with family and friends to prevent members of his wife’s family, who he said had threatened him in the past, from finding him.

Goldstein’s attorney, Aiden O’Connor, asked why his client would have incentive to force a get. Bryskman acknowledged he was trying to get permission from a special rabbinical court in Brooklyn – on which Goldstein sat – to be allowed to remarry without giving his wife a get.

Chasidic Abuse Whistleblower Suing Dershowitz Brothers

Four years after his life was turned upside down by charges he committed extortion and bribery, chasidic sex abuse whistleblower Sam Kellner is fighting back against those he thinks wronged him in the press. Late last year he sued The Jewish Daily Forward for defamation. And last week he filed papers initiating a defamation action against Alan and Nathan Dershowitz, the high-profile lawyers who represented, Baruch Lebovits, who Kellner alleges sexually abused his son.

Kellner, who brought allegations of his son’s abuse by Lebovits to the police in 2008, worked closely with law enforcement to bring forward additional Lebovits victims. Lebovits was convicted in 2010 and sentenced to 10 ½ to 32 years in prison. A year later, in 2011, Kellner was arrested.

In 2012, Lebovits’ conviction was vacated on appeal because of a prosecution error, and a new trial was ordered. Lebovits ultimately pleaded guilty in May of 2014, avoiding a second trial. (He was sentenced to two years but because of time served and what’s called “good time” credits, he ended up serving only a few months.) For his appeal and subsequently, Alan and Nathan Dershowitz were part of Lebovits’ defense team.

The case against Kellner — which included allegations that he paid one man to falsely testify in a grand jury that he was abused by Lebovits and also sent emissaries to attempt to extort the Lebovits family for hundreds of thousands of dollars in exchange for a promise he could persuade the witnesses against him to drop their charges — was based virtually exclusively on evidence brought directly to the former Brooklyn District Attorney Charles Hynes’ Rackets Division by members of the Lebovits family, their supporters and paid agents. Kellner’s attorneys and others have argued that the charges against Kellner were fabricated in order to get Lebovits out of jail and undermine the district attorney’s ability to retry him.

In March of 2014, after a review of the case, current Brooklyn district attorney Ken Thompson asked a judge to dismiss the charges against Kellner. Speaking on the day of the dismissal, ADA Kevin O’Donnell told the court that the witnesses against Kellner “lack credibility to such a degree that their testimony cannot be trusted” and thus the case could not be prosecuted.

On that same day, according to a summons with notice filed by Kellner in Manhattan on Friday, both Alan and Nathan Dershowitz made defamatory statements about Kellner. According to the filing, Alan Dershowitz “published to a third party without privilege or authorization the defamatory statement that the Brooklyn District Attorney possessed a ‘smoking gun’ recording of Plaintiff that proved he committed extortion.” 

This is a reference to a column in The New York Times, written by Michael Powell, in which Powell wrote that after the dismissal of Kellner’s case, “Mr. Dershowitz roamed the hallway … playing with a grin the more disquieting for the fact that his eyes ran cobalt. He spoke ominously, as he has for years, of new evidence. ‘This case is not over,’ he said. Mr. Kellner ‘may very well still be going to jail because this tape is the smoking gun.’”

The filing also notes that on that same day Nathan Dershowitz, “published to a third party without privilege or authorization the defamatory statement that the Brooklyn District Attorney possessed ‘tape recordings’ that proved Plaintiff was guilty of extortion.”

This is a reference to a New York Daily News story in which Nathan Dershowitz is quoted as saying, “Any suggestion that they can’t get a conviction is strange, and what makes it stranger is that they have tape recordings [of the alleged extortion].”

Kellner, who is representing himself, has yet to file a complaint, which would provide more detail about the basis for his claims and the type of relief he is seeking.

In response to the news of the filing, Alan Dershowitz told The Jewish Week that “[e]verything I said is constitutionally protected speech and advocacy.”

Andrew T. Miltenberg, an attorney who specializes in defamation law, among other areas, disagrees.

“First, the statement is poor form and I believe, irresponsible,” Miltenberg told The Jewish Week.

“It is not protected by a qualified privilege since there was no pending action at the time of the statement, nor was the statement made in a pleading or otherwise inside a courtroom during a pending action. The statement itself is defamatory,” he continued “as it states that there is evidence that Mr. Kellner committed a crime, notwithstanding the fact that the case against him was dismissed.”

For his part, Nathan Dershowitz, told The Jewish Week that “Mr. Kellner’s filing is frivolous and your reporting such a frivolous claim is bad journalism.” He added that “it will be interesting exploring Kellner’s reputation to see if and how he alleges he has been specifically damaged.”

According to Miltenberg, Kellner would likely assert a claim of what is known as defamation per se, which does not require him to allege special damages. Damages are assumed because he was accused of a crime. That said, Miltenberg told The Jewish Week that, in his view, Nathan Dershowitz’s statement is not defamatory.

As for Kellner, he would not comment on the filing except to say that he is not suing “for financial gain.”

“This is just to show for every kid, no matter how small you think you are, in the end the truth is going to come out,” he said. “This is to give courage to those people. The top-notch lawyers are coming against you. You feel like you’re just a loner. But justice is going to come out in the end.”

A child abuse survivor has criticised the Government’s decision to lock the personal witness statements victims gave to state investigations away for 75 years as “very extreme” and “odd”.

Andrew Madden made the remarks after the Cabinet confirmed it is to withhold the evidence for privacy and legal advice reasons.

The decision not to make the files publicly available is based on recommendations in the Ryan report. It was put forward yesterday by Jan O’ Sullivan, the education minister, and will see the files withheld for almost twice as long as State papers are normally kept.

The Labour TD is now due to draft legislation based on the decision to keep the records private for 75 years, although she has stressed she is open to making some of the information more readily available if reasons are given.

Mr Madden told the Irish Examiner last night that he does not understand why the information would not be released until 2090 as the facilities involved are indemnified from legal action.

He also questioned why the Government believes that those who spoke to the Ryan report about their personal experiences would be against making the information public, as they have previously criticised arguments that if they accepted a settlement they could not speak about what happened.

“It is really a personal decision, but 75 years is a lot of time to not publish this. I find it quite odd that the records would be withheld for this long,” he said.

In a statement last night, a spokesperson for Ms O’Sullivan said the move is based on the Ryan report recommendations. “Certain records of archival value will be sealed for 75 years from this year.

“The legislation will relate to records held by Commission to Inquiry into Child Abuse, Residential Institutions Redress Board and the Residential Institutions Review Committee,” said the spokesperson.

University of Arizona Investigates Allegations That a Campus Church Group Is an ‘Insidious’ Cult

The University of Arizona has opened up an investigation into an on-campus church after former members and staffers have come forward accusing the church of being a cult, according to Arizona Daily Star.

Faith Christian Church, which rose out of the ashes of former Tucson chapter of Maranatha Christian Church,  has been operating on the UA campus since its founding in 1990.

In an investigation led by the Star, former members and staffers accused the church of hitting infants with cardboard tubes to encourage submission, using financial coercion to hold onto members, compelling alienation from parents, and public shaming of members, including shunning former members who leave the church or question its leadership.

Former members claim they suffer from panic attacks, depression, anxiety, and other symptoms of post-traumatic stress disorder after escaping the clutches of the church.

Faith Christian is led by founder and head pastor, Stephen M. Hall, a self-professed former criminal who boasts of being busted for running a marijuana farm as well as working as an enforcer for a Florida drug lord. Hall has not responded to a list of questions submitted by the Star.

According to critics, the church actively recruits young vulnerable students, “love-bombing” them to break down their defenses.

“They shower you with attention and they’re super nice. They became my instant friends,” said Rachel Mullis, 38, who was a member of the church for 10 years and was approached on her first day at the college. “If they came right out and told you from the start that it’s a cult, you’d never get involved. They make it seem really amazing at first, then they hook you in little by little.”

Ex-member Scott Moore, 32, who graduated from UA in 2005, called their methods “insidious,” saying the church leaders’ criticism and authoritarianism kept him in a state of near-constant anxiety.

Los Angeles resident Kathy Sullivan contacted UA administrators after her son told her he wanted to abandon his planned career after graduation and become a campus minister for Faith Christian.

“They get their members to believe that any questioning, any scrutiny, it’s the devil,” Sullivan said. “I want to get my son out of there. I want to do whatever I can to prevent other families from letting their children get in a situation like this.”

According to university administrators, they were unaware of problems within the church until confronted with information gathered by the Daily Star. The school claims they only respond to formal complaints and don’t monitor the church’s activities. Former members say filing complaints was difficult with the church tightening its grip on students, even after graduation. Additionally the university is hindered by Arizona law that requires all state agencies to “neither inhibit nor promote religion.”

Faith Christian encourages some members to become “campus ministers”  after graduation, recruiting other UA students into the church. Campus ministers stand outside of dorms on move-in day offering help, or approach students claiming to be taking a survey with a promise of a chance to win a bicycle or other prize.

One former member says he is coming forward now, hoping that his kids don’t some day fall into the same trap that he calls “Traumatic.”

According to Lawrence Alfred, 38, the church robbed him of his freedom slowly over a period of time, penalizing him with a ritual called “casting the demons out” for small infractions, including spending too much time alone.

“You don’t know yourself at the end,” says Alfred, who left after nine years. “You don’t know you’re in a cult until you leave. Pretty soon, you’re at the point where you can’t make any decisions.”

“I’m doing this for my kids,” he says of his decision to go public. “If they go off to college, I don’t want them to fall into the same trap.”
